This Disclaimer applies to all automated accessibility scans performed by Comply, operated by JK.Creative LLC. Please read this carefully before relying on scan results for compliance decisions, legal proceedings, or remediation prioritization.

1. Automated Scanning Limitations

Comply uses axe-core, an industry-standard open-source accessibility testing engine, to detect WCAG 2.1 AA violations. Automated tools like axe-core are valuable for identifying a subset of accessibility issues quickly, but they have fundamental limitations.

Research consistently shows that automated accessibility scanning tools detect approximately 30–40% of WCAG issues. The majority of WCAG success criteria — those requiring human judgment about context, meaning, or user experience — cannot be evaluated by automated tools at all.

Issues that automated scans can typically detect include:

• Missing or empty alt text on images
• Insufficient color contrast ratios
• Missing form labels
• Absent or malformed landmark regions
• Missing document language declarations

Issues that automated scans cannot reliably detect include:

• Whether alt text is meaningful and accurate
• Whether the logical reading order matches the visual order
• Keyboard navigation usability and focus management quality
• Screen reader compatibility in real assistive technology environments
• Cognitive load and plain language compliance
• Complex interactive widget behavior and ARIA implementation correctness in context

2. Not a Substitute for Manual Testing

Comply scan results should be treated as a starting point, not a finish line. A scan that returns zero violations does not mean a website is accessible. It means no violations were detectable by the automated engine on the pages scanned at that moment.

Comprehensive accessibility evaluation requires manual testing by qualified accessibility professionals, including:

• Keyboard-only navigation testing
• Screen reader testing with NVDA, JAWS, VoiceOver, and/or TalkBack
• Testing with actual users who have disabilities
• Expert review against all applicable WCAG success criteria

We strongly recommend pairing Comply with manual testing to achieve meaningful accessibility coverage.

3. Not Legal Advice

Comply does not provide legal advice. Nothing in our scan reports, documentation, guidance text, or communications should be construed as legal advice or as a legal opinion regarding compliance with any law or regulation.

Accessibility law — including the Americans with Disabilities Act (ADA), Section 508 of the Rehabilitation Act, the European Accessibility Act, EN 301 549, and equivalent laws in other jurisdictions — is interpreted and applied by courts and regulators, not by automated testing tools. Legal compliance is a legal question. Consult a qualified attorney for guidance on your specific obligations.

4. No Guarantee Against Lawsuits or Regulatory Action

Using Comply does not protect you from accessibility-related lawsuits, demand letters, regulatory investigations, or complaints. A clean scan result is not a legal defense. Courts and regulatory bodies assess accessibility based on the actual experience of people with disabilities, not on automated tool output.

JK.Creative LLC makes no representation that using Comply will reduce your legal exposure or satisfy any legal accessibility obligation.

5. Point-in-Time Snapshots

Each scan reflects the state of a page at the exact moment it was scanned. Websites change — content is updated, features are added, third-party scripts are modified. A page that passed a scan last week may have new violations today.

Scan results are retained for 12 months as historical records. They do not represent the current accessibility state of a site unless a scan was run recently.

6. Third-Party and Dynamic Content

Comply scans the DOM as rendered in a headless browser at scan time. The following types of content may not be fully evaluated:

• Content loaded after user interaction (modals, dropdowns, accordions, infinite scroll)
• Content behind authentication or paywalls
• Third-party widgets, embeds, chat tools, and ad units that load asynchronously
• Content injected by client-side JavaScript after the initial page load
• Content in iframes served from different origins

Violations in these areas will not appear in scan results even if they exist.

7. Your Responsibility

You are responsible for:

• Reviewing and interpreting scan results in the context of your site and your users
• Verifying that suggested remediations are appropriate for your specific implementation
• Conducting additional manual testing to identify issues beyond automated scan coverage
• Making your own determination about whether your site meets applicable legal requirements
• Only submitting URLs that you own or have explicit authorization to scan

Comply provides data. Acting on that data — and the adequacy of that action — is entirely your responsibility.

8. Limitation of Liability

JK.Creative LLC’s liability in connection with scan results and their use is limited as described in our Terms of Service. We are not liable for any legal claim, regulatory action, lawsuit, or damage arising from your reliance on scan results.
